KULLANIM ŞARTLARI VE EĞİTİM KOŞULLARI

1. Taraflar

İşbu Kullanım Şartları ve Eğitim Koşulları;

  • Coatek Akademi
    Resmî Ünvan: Coatek Mühendislik Boya İnş. San. ve Tic. Ltd. Şti.
    (Bundan sonra “Lisans Sahibi” veya “Coatek Akademi” olarak anılacaktır)

ile

  • AMPP lisansı kapsamında düzenlenen eğitim programlarına kayıt yaptıran gerçek kişi
    (Bundan sonra “Katılımcı” olarak anılacaktır)

arasında düzenlenmiştir.

Katılımcı, kayıt işlemini tamamlayarak işbu metnin tamamını okuduğunu, anladığını ve kabul ettiğini beyan eder.

2. Hukuki Dayanak ve Uyum

Bu Kullanım Şartları;

  • AMPP License Agreement

  • AMPP Operations Manual

  • AMPP sınav, sertifikasyon, sağlık ve etik politikaları

  • Türkiye Cumhuriyeti mevzuatı

ile uyumlu olarak hazırlanmıştır.

AMPP tarafından yayımlanan kural ve talimatlarda değişiklik olması hâlinde, AMPP kuralları öncelikli olarak uygulanır.

3. Eğitimlerin Niteliği

  • Eğitimler, AMPP tarafından onaylanmış müfredat ve içerikler doğrultusunda yürütülür.

  • Eğitimler yalnızca AMPP onaylı eğitmenler tarafından verilir.

  • Eğitim dili, süresi, sınav şekli ve sertifikasyon koşulları AMPP tarafından belirlenir.

  • Coatek Akademi, AMPP adına sertifika düzenlemez; sertifikasyon yetkisi yalnızca AMPP’ye aittir.

4. Ön Kayıt ve Kesin Kayıt

4.1 Ön Kayıt

  • Katılımcılardan, kontenjan planlaması amacıyla ön ödeme alınarak ön kayıt yapılabilir.

  • Ön kayıt, katılımcıya kesin yer garantisi vermez.

  • Ön kayıt, yalnızca katılımcının eğitime katılma niyetini ifade eder.

4.2 Kesin Kayıt

  • Kesin kayıt, eğitim ücretinin tamamının ödenmesi ile gerçekleşir.

  • Tam ödeme yapılmayan katılımcılar:

    • Eğitime alınmayabilir

    • Sınavlara katılamaz

    • Sertifikasyon sürecine dahil edilmez

Bu durumlarda Coatek Akademi’nin herhangi bir sorumluluğu bulunmaz.

5. Eğitim Ücretleri ve Ödeme

  • Eğitim ücretleri, duyurulan program bazında belirlenir.

  • Tüm ödemeler, eğitim başlangıcından önce tamamlanmalıdır.

  • Banka, havale ve ödeme altyapılarından kaynaklanan masraflar katılımcıya aittir.

6. Eğitim Ücretine Dahil Olan ve Olmayan Hizmetler

6.1 Ücrete Dahil Olan Hizmetler

Eğitim ücretine yalnızca aşağıdaki hizmetler dahildir:

  • AMPP onaylı eğitim programına katılım

  • Eğitim süresince kullanılan basılı ve/veya dijital eğitim materyalleri

  • Eğitim süresince eğitmen hizmeti

  • AMPP sınav ücreti (aksi ayrıca belirtilmedikçe)

  • Eğitim günleri boyunca öğle yemekleri

  • Eğitim süresince sunulan çay, kahve ve ikramlar

6.2 Ücrete Dahil Olmayan Hizmetler

Aşağıdaki hizmetler eğitim ücretine dahil değildir:

  • Konaklama

  • Ulaşım (uçak, otobüs, tren, transfer vb.)

  • Vize, pasaport ve seyahat sigortası

  • Akşam yemekleri ve kişisel harcamalar

  • Sınav tekrarları (retake)

  • AMPP bireysel üyelik ücretleri

Bu giderlerden tamamen katılımcı sorumludur.

7. İptal, Erteleme ve Katılamama Koşulları

7.1 Katılımcının Kendi İradesiyle İptali veya Katılamaması

  • Katılımcının, herhangi bir gerekçe ile eğitime katılamayacağını bildirmesi hâlinde ücret iadesi yapılmaz.

  • Katılımcı, eğitime katılamayacağını yazılı olarak bildirmek kaydıyla, eğitimi ileride açılacak aynı seviyedeki bir programa ücretsiz erteleme hakkına sahiptir.

  • Erteleme talebi, eğitim başlangıç tarihinden en geç 15 (onbeş) gün önce yazılı olarak iletilmelidir.

  • Ertelenen eğitime mazeretsiz olarak katılım sağlanmaması hâlinde:

    • Tüm haklar sona erer

    • Ücret yanar

    • Yeni bir erteleme veya iade hakkı doğmaz

7.2 Katılımcının Eğitime Hiç Katılmaması (No-Show)

  • Katılımcının herhangi bir bildirimde bulunmaksızın eğitime katılmaması hâlinde:

    • Ücret iadesi yapılmaz

    • Erteleme hakkı tanınmaz

    • Katılımcı tüm haklarını kaybeder

Bu durum, organizasyon ve eğitmen maliyetleri nedeniyle katılımcının kusuru olarak değerlendirilir.

7.3 Sağlık ve Mücbir Sebepler

  • Katılımcının ciddi sağlık sorunu veya mücbir sebep nedeniyle eğitime katılamaması hâlinde, belgelendirilmesi şartıyla, AMPP’nin Health & Well Being Policy hükümleri uygulanır.

  • Bu kapsamda Coatek Akademi tarafından açılacak uygun ileri tarihli bir eğitim organizasyonuna cezasız erteleme hakkı tanınır.

  • Belgelendirilemeyen durumlarda 7.1 maddesi uygulanır.

7.4 Coatek Akademi Tarafından Eğitimin Ertelenmesi yada İptali

  • Coatek Akademi, eğitmen uygunluğu, katılımcı sayısı, operasyonel zorunluluklar veya AMPP kaynaklı nedenlerle eğitimi erteleyebilir veya iptal edebilir.

  • Bu durumda:

    • Ertelenen eğitimlerde; katılımcıya yeni eğitim tarihi için kayıpsız hak transferi

    • Takip eden 12 aylık süre içerisinde aynı/eşdeğer program açılamayacaksa tam ücret iadesi hakkı sunulur.

  • Coatek Akademi; katılımcının yaptığı ulaşım, konaklama, vize veya benzeri masraflardan sorumlu değildir. Bu sebeple ulaşım/konaklama rezervasyonlarının eğitim tarihinden 28 gün öncesine kadar yapılmaması ve Coatek Akademi’den kurs için teyit alınması tavsiye edilir.

7.5 Eğitmenin Eğitime Katılamaması

  • Eğitmenin sağlık sorunu, mücbir sebep veya AMPP kaynaklı nedenlerle eğitime katılamaması hâlinde:

    • Eğitim ertelenir veya

    • AMPP tarafından onaylı başka bir eğitmen atanır

Bu durum katılımcı iptali olarak değerlendirilmez.

7.6 AMPP Kaynaklı Değişiklikler

  • AMPP tarafından alınan kararlar doğrultusunda eğitim tarihleri, eğitmen atamaları veya sınav uygulamaları değiştirilebilir.

  • Bu tür değişikliklerde AMPP kuralları önceliklidir.

·        AMPP tarafından yapılacak kural, sınav veya sertifikasyon değişiklikleri bağlayıcıdır ve katılımcıya iade hakkı doğurmaz

8. Sınav ve Sertifikasyon

  • Sınavlar AMPP kurallarına uygun şekilde uygulanır.

  • Sınav sonuçları yalnızca AMPP sistemleri üzerinden açıklanır.

  • Sınav tekrarları (retake) ücretlidir ve AMPP kurallarına tabidir.

  • Disiplinsiz davranış, sınav güvenliğini ihlal veya etik dışı tutum hâlinde katılımcı dersten çıkarılabilir ve bu durumda ücret iadesi yapılmaz.

9. Fikri Mülkiyet Hakları

  • Eğitim materyalleri, sunumlar, dokümanlar ve sınav içerikleri AMPP’ye aittir.

  • İzinsiz kopyalama, çoğaltma veya paylaşım yasaktır.

  • İhlal hâlinde AMPP ve Coatek Akademi yasal haklarını saklı tutar.

10. Sorumluluğun Sınırlandırılması

  • Coatek Akademi, dolaylı zararlar, gelir kaybı veya iş kaybı taleplerinden sorumlu değildir.

  • Eğitim veya sertifika, iş bulma veya terfi garantisi anlamına gelmez.

11. Uygulanacak Hukuk ve Yetki

  • İşbu şartlar Türkiye Cumhuriyeti Hukuku’na tabidir.

  • Uyuşmazlıklarda İzmir Mahkemeleri ve İcra Daireleri yetkilidir.

12. Yürürlük ve Kabul

Katılımcı, kayıt işlemini tamamlayarak işbu Kullanım Şartları’nı kabul etmiş sayılır.

TERMS AND CONDITIONS AND TRAINING PROVISIONS

1. Parties

These Terms and Conditions and Training Provisions are entered into between:

Coatek Academy
Official Trade Name: Coatek Mühendislik Boya İnş. San. ve Tic. Ltd. Şti.
(hereinafter referred to as the “Licensee” or “Coatek Academy”)

and

The natural person who registers for training programs organized under the AMPP license
(hereinafter referred to as the “Participant”).

By completing the registration process, the Participant declares that they have read, understood, and accepted the entirety of this document.

2. Legal Basis and Compliance

These Terms and Conditions have been prepared in compliance with:

  • AMPP License Agreement

  • AMPP Operations Manual

  • AMPP examination, certification, health, and ethics policies

  • Applicable laws of the Republic of Türkiye

In the event of any changes to rules or instructions published by AMPP, AMPP rules shall prevail.

3. Nature of the Trainings

  • Trainings are conducted in accordance with curricula and content approved by AMPP.

  • Trainings are delivered exclusively by AMPP-approved instructors.

  • The training language, duration, examination format, and certification requirements are determined by AMPP.

  • Coatek Academy does not issue certificates on behalf of AMPP; certification authority rests solely with AMPP.

4. Pre-Registration and Final Registration

4.1 Pre-Registration

  • Pre-registration may be accepted through advance payment for the purpose of capacity planning.

  • Pre-registration does not guarantee a confirmed seat in the training.

  • Pre-registration only represents the Participant’s intention to attend the training.

4.2 Final Registration

  • Final registration is completed only upon full payment of the training fee.

  • Participants who have not completed full payment may:

    • Be denied access to the training

    • Be excluded from examinations

    • Be excluded from the certification process

In such cases, Coatek Academy shall bear no liability whatsoever.

5. Training Fees and Payment

  • Training fees are determined on a program-specific basis as announced.

  • All payments must be completed prior to the start of the training.

  • Any bank charges, transfer fees, or payment system costs are the responsibility of the Participant.

6. Services Included in and Excluded from the Training Fee

6.1 Services Included in the Training Fee

The training fee includes only the following services:

  • Participation in the AMPP-approved training program

  • Printed and/or digital training materials used during the course

  • Instructor services during the training

  • AMPP examination fee (unless otherwise stated)

  • Lunches provided during the training days

  • Tea, coffee, and refreshments served during the training

6.2 Services Not Included in the Training Fee

The following services are not included in the training fee:

  • Accommodation

  • Transportation (air, bus, train, transfers, etc.)

  • Visa, passport, and travel insurance

  • Dinners and personal expenses

  • Examination retakes

  • AMPP individual membership fees

All such expenses are solely the responsibility of the Participant.

7. Cancellation, Postponement, and Non-Attendance Conditions

7.1 Cancellation or Inability to Attend by the Participant

  • If the Participant informs that they will not be able to attend the training for any reason, no refund shall be issued.

  • Provided that the Participant notifies in writing, the Participant is entitled to a one-time free postponement to a future training of the same certification level.

  • The postponement request must be submitted in writing no later than 15 (fifteen) days prior to the training start date.

  • If the Participant fails to attend the postponed training without valid justification:

    • All rights shall be forfeited

    • The paid fee shall be forfeited

    • No further postponement or refund rights shall arise

7.2 Failure to Attend Without Notice (No-Show)

If the Participant fails to attend the training without any prior written notice:

  • No refund shall be issued

  • No postponement right shall be granted

  • The Participant shall forfeit all rights

Such cases are deemed to be the fault of the Participant due to organizational and instructor-related costs incurred.

7.3 Health Issues and Force Majeure

  • In the event that the Participant is unable to attend the training due to serious health issues or force majeure, and provided that such circumstances are properly documented, AMPP’s Health & Well Being Policy shall apply.

  • In such cases, the Participant shall be granted a penalty-free postponement to a future training session deemed appropriate and scheduled by Coatek Academy.

  • In the absence of proper documentation, Clause 7.1 shall apply.

7.4 Postponement or Cancellation by Coatek Academy

  • Coatek Academy may postpone or cancel a training due to instructor availability, number of participants, operational necessities, or AMPP-related reasons.

  • In such cases:

    • For postponed trainings, Participants shall be granted a loss-free transfer of rights to the new training date.

    • If the same or an equivalent program cannot be opened within the following 12 (twelve) months, the Participant shall be entitled to a full refund.

  • Coatek Academy shall not be liable for any transportation, accommodation, visa, or similar expenses incurred by the Participant.

  • Participants are therefore advised not to make travel or accommodation arrangements earlier than 28 days prior to the training date and to obtain confirmation from Coatek Academy before doing so.

7.5 Instructor Unavailability

  • If the assigned instructor is unable to conduct the training due to health issues, force majeure, or AMPP-related reasons:

    • The training shall be postponed, or

    • Another AMPP-approved instructor shall be assigned

Such situations shall not be considered Participant-initiated cancellations.

7.6 AMPP-Originated Changes

  • Training dates, instructor assignments, or examination procedures may be changed in accordance with decisions taken by AMPP.

  • In such cases, AMPP rules shall prevail.

  • Any rule, examination, or certification changes made by AMPP are binding and shall not give rise to any refund rights for the Participant.

8. Examination and Certification

  • Examinations are conducted in accordance with AMPP rules.

  • Examination results are announced solely through AMPP systems.

  • Examination retakes are subject to additional fees and AMPP rules.

  • In cases of disorderly conduct, breach of examination security, or unethical behavior, the Participant may be removed from the training, and no refund shall be issued.

9. Intellectual Property Rights

  • Training materials, presentations, documents, and examination content are the property of AMPP.

  • Unauthorized copying, reproduction, or distribution is strictly prohibited.

  • In the event of any violation, AMPP and Coatek Academy reserve all legal rights.

10. Limitation of Liability

  • Coatek Academy shall not be liable for indirect damages, loss of income, or loss of business.

  • Participation in a training or receipt of a certificate does not constitute a guarantee of employment or promotion.

11. Governing Law and Jurisdiction

  • These Terms and Conditions shall be governed by the laws of the Republic of Türkiye.

  • The courts and enforcement offices of İzmir shall have exclusive jurisdiction over any disputes.

12. Entry into Force and Acceptance

By completing the registration process, the Participant shall be deemed to have accepted these Terms and Conditions.
